UPDATE - 12/3/09: No Deal For Kitty Cooker 2 Year Jail Term Instead SOURCE: Bronx teen Cheyenne Cherry gets two years for roasting cat in oven 12/3/09, SUMMARY: We reported (7/15/09) that Bronx kitten killer Cheyenne Cherry, 17, had plea-bargained her way to a 1-year jail term with a 3-year ban on "pets." Instead, she'll spend 2 years in jail for roasting Tiger Lilly in a 500-degree oven during an attempted burglary 5/6/09 at former friend Valerie Hernandez' apartment. Cherry's accomplice, 14, was sentenced in August to 18 months in juvenile jail. Cherry's restriction on animals still stands at three years and she is subject to three years of post-release supervision. Cherry faces formal sentencing on Jan. 21, 2009. Two years is not full justice for Tiger Lilly's killing. But after months of court adjournments, with your comments pouring in, Cherry's first plea deal fell apart. Kinship Circle letter writers, along with campaigns from In Defense of Animals and other groups, highlighted the gravity of this crime. IDA writes: "Prosecutors and judge were enlightened about the importance of bringing charges of animal cruelty, along with a stiff sentence." UPDATE - 7/15/09: Cheyenne Cherry - 1 Year Jail + No Animals For 3 Years SOURCE: Teen Cheyenne Cherry taunts animal activists after guilty plea for killing kitten in oven PLEA: Guilty on animal cruelty and attempted burglary in 5/6/09 killing at former roommate's apartment. Cheyenne Cherry and a 14- year-old friend ransacked Valerie Hernandez's apartment and trapped her kitten, Tiger Lilly, inside an activated oven where the animal roasted alive. In court 7/15/09, Cherry admitted to Judge Margaret Clancy that the younger girl put the cat in the oven — and "I didn't let the cat out." PENALTY: Plea bargain results in one-year jail sentence. Under the agreement, Cherry pleaded guilty to two charges in a six-count indictment. She waived her right to appeal and agreed not to keep a pet for the next three years. Cherry faces formal sentencing July 31, 2009. The second girl faces trial in Family Court because of her age. Prosecutor Jennifer Troiano said Cherry was granted a plea deal because her cohort was "more culpable" for the crimes. I understand Cheyenne Cherry, 17, is charged with felony aggravated animal cruelty, burglary, arson, criminal trespass, reckless endangerment and criminal mischief. I respectfully ask for your utmost deliberation in the investigation of Cherry and her accomplice, who allegedly broke into ex-roommate Valerie Hernandez's home and trapped Tiger Lily inside an activated stove. Apparently, they ransacked the apartment and raised the stove's heat before fleeing with stolen items. The girls never heard Tiger Lily's last screams and scratches against the oven door. Please seek the maximum adult incarceration of two years for felony animal cruelty. Cherry also faces possible jail terms of 15 years for second-degree burglary, one year for arson, and four years for criminal mischief. I urge you to hold both teens accountable. Both require psychological evaluation and therapy. Both should be barred from possessing or working with animals. At the very least, they ought to be interned in a juvenile detention hall until age 18 (if applicable). Then, reassessment of the girls' personality traits can determine if adult imprisonment is necessary. Adolescents who commit brutal crimes against humans usually begin with animals. Columbine shooter Eric Harris, 18, smashed mice with a crowbar and set them on fire. Washington D.C. serial killer Lee Boyd Malvo killed stray cats with a slingshot. Kip Kinkle blew up a cow and burned a live cat. He then shot 25 classmates and murdered his parents in Springfield, Oregon. After Luke Woodham, 16, mortally stabbed his mother and shot nine others, he confessed to bludgeoning his dog and setting her on fire. As a teen, Jason Massey slaughtered 37 cats, 29 dogs and six cows; at 20 he decapitated and disemboweled a girl, 13, and shot a boy, 14. These murderers, like Cherry, were able to torture and kill without remorse. Indeed, the intentional burning of an animal "should be considered particularly significant as...a predictor of violent and even homicidal behavior," says Dr. Randall Lockwood of ASPCA Anti-Cruelty Initiatives and a frequent consultant for cruelty investigators, law enforcers and mental health professionals. Cherry "thought we'd play a joke on Valerie." But she and her friend are not guilty of warped humor or bad choices. Roasting a defenseless kitten is the calculated action of a sociopath and a predator. Thank you for prosecuting Cherry and her accomplice to the fullest degree allowed by law. Sincerely, |
